Terms of Service

Please read these Terms carefully before using lacuniq.com. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and lacuniq.com ("we," "us," or "our") governing your access to and use of the lacuniq.com website and application (collectively, the "Service").

By registering for an account, clicking "I agree," or otherwise accessing the Service, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy, which is incorporated into these Terms by reference.

2. Eligibility

You must be at least 16 years of age to use the Service. By creating an account, you represent and warrant that:

  • You are at least 16 years old.
  • You have the legal capacity to enter into a binding agreement in your jurisdiction.
  • You are not located in a jurisdiction where access to or use of the Service is prohibited by law.

3. The Service

lacuniq.com is an AI-powered keyword research and market niche discovery platform designed for online entrepreneurs, bloggers, and small business owners. The Service enables users to identify low-competition market niches and keyword opportunities using real search data and AI-based analysis.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes that affect paid functionality, we will provide at least 14 days' notice by email or in-app notification.

4. Account Registration

To access the Service, you must create an account with a valid email address and a password, or authenticate via Google OAuth. You are responsible for:

  • Providing accurate and complete information during registration and keeping it up to date.
  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account, whether authorized by you or not.
  • Notifying us immediately of any suspected unauthorized access at support@lacuniq.com.

You may not create more than one account per person, transfer your account to another person, or share your account credentials with others. We reserve the right to terminate duplicate or fraudulently created accounts.

5. Credits and Payments

The Service operates on a credit-based model. Credits are consumed when you run analyses. The credit cost per analysis is described on the pricing page and within the application.

Free credits:

  • Every new account receives 5 free credits upon registration, at no cost and with no credit card required.
  • Users who register via a referral link receive 7 free credits instead.

Purchased credits:

  • Credits are purchased in packages. Once purchased, credits never expire and are tied to your account.
  • Payments are processed by our payment processing partner. By completing a purchase, you authorize us to charge the specified amount to your selected payment method.
  • All prices are displayed in USD unless otherwise stated.

Automatic credit return: If an analysis fails to return any results due to a system error or data unavailability, the credits consumed by that analysis are automatically returned to your account balance.

Refunds: Purchased credits are generally non-refundable, except where required by applicable law. We may issue refunds at our sole discretion on a case-by-case basis. To request a refund, contact us at support@lacuniq.com with your account email and a description of the issue.

UK and EU users: You may have a statutory right to cancel a purchase within 14 days under applicable consumer protection law. However, by initiating an analysis, you expressly consent to the immediate provision of the service and acknowledge that your right of withdrawal may be lost once the analysis has been delivered. 6. Referral Program

You may invite others to join the Service using your unique referral link. When a referred user registers, both the referrer and the new user receive bonus credits as described in the application. We reserve the right to modify or discontinue the referral program at any time, and to void referral credits obtained through fraudulent or abusive means.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Reverse-engineer, decompile, scrape, or otherwise extract data from the Service beyond its intended use, including automated bulk data extraction.
  • Resell or sublicense access to the Service without our prior written consent.
  • Generate, distribute, or facilitate spam, misleading content, or deceptive schemes.
  • Attempt to gain unauthorized access to our systems, servers, or other users' accounts.
  • Conduct any action that places an unreasonable or disproportionate load on our infrastructure.
  • Use the Service in any way that could damage, disable, or impair our systems or interfere with other users' enjoyment of the Service.

Violation of this section may result in immediate suspension or permanent termination of your account, without refund of any unused credits.

8. Intellectual Property

The Service, including its software, design, user interface, trademarks, logos, and content created by us, is owned by lacuniq.com and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal or internal business purposes in accordance with these Terms.

You retain all rights to data and content you input into the Service. You grant us a limited licence to process your input data solely to provide the Service to you. Analysis results generated by the Service may be used for your personal or business purposes. You may not redistribute or resell analysis results as a standalone data product or service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Keyword and niche data is sourced from third-party data providers and reflects historical search trends. It should be used as one input among many when making business decisions and does not constitute a guarantee of commercial success or profitability.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LACUNIQ.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless lacuniq.com and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or third-party right; or (c) any content or data you submit through the Service.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the operator of lacuniq.com is established, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction. If you are a consumer in the UK or EU, you may also be entitled to bring proceedings in the courts of your country of residence.

13. Termination

Either party may terminate the relationship under these Terms at any time.

  • You may delete your account at any time by contacting us at support@lacuniq.com. Any unused credits will be forfeited upon account deletion unless a refund is granted at our discretion.
  • We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we discontinue the Service. In cases of termination for cause, unused credits are non-refundable.

Sections 8–12 of these Terms survive termination.

14. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will notify you by email at least 14 days before the new Terms take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service before the effective date.
